Pursuant to art. 52 of Italian Legislative Decree no. 206/2005 (Consumer Code) the consumer has the right to withdraw from the purchasing contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which the customer acquire, or a third party other than the carrier and indicated by the customer acquires, physical possession of the goods.

To exercise the right of withdrawal, the customer must inform Cortesa S.r.l. of his decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax, or e-mail). The customer may use the withdrawal form attached to the parcel, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Exceptions to withdrawal

The right of withdrawal applies to consumers only - i.e. retailers and any other parties who purchase items in order to re-sell them to third parties are excluded.
The right of withdrawal does not apply to goods made to specifications or clearly personalized or which by their nature, are liable to deteriorate (groceries, wines, spirits and beverages), are sealed and aren't suitable themselves to be returned for hygienic reasons or are related to the protection of health and have been unsealed after delivery.

Timing of return

The customer shall send back the goods or hand them over to the sender without undue delay and in any event not later than 14 days from the day on which he communicates its withdrawal from this contract. The deadline is met if the customer send back the goods before the period of 14 days has expired. For all products we will bear the cost of returning the goods, provided that you follow the return process specified below otherwise you will have to bear the return costs.

Refund

If the customer withdraws from this contract, Cortesa S.r.l. shall reimburse to him all payments received, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which he sent the withdrawal letter.
Cortesa S.r.l. may withhold reimbursement until it has received the goods back or the customer has supplied evidence of having sent back the goods, whichever is the earliest.

Decrease in the value of the goods

The customer will be liable for any decrease in the value of the item(s) if the deterioration is caused by a use beyond the ordinary quality inspection and functional testing of the product.
